Public Interest Lawyers Take Legal Action Against FG and Concessionaire Over Benin–Asaba Expressway Deterioration

A coalition of public-interest lawyers has filed a lawsuit against the Federal Government and the concessionaire managing the Benin–Asaba Expressway, highlighting the urgent need for action due to the road's deteriorating condition. The legal action underscores the belief that the safety of motorists should take precedence over contractual agreements, especially when lives are at stake.

According to the lawyers, the current state of the road poses significant risks to drivers and passengers alike. They assert that the government and the concessionaire have both failed to fulfill their responsibilities in maintaining the expressway, which has become increasingly hazardous due to potholes and inadequate signage.

"The condition of the road should not be left as a contractual matter between the government and the concessionaire when motorists' safety is at stake," said a representative from SPI-LAW, the group leading the lawsuit.

The Benin–Asaba Expressway is a critical artery for transportation in the region, linking Edo and Delta States, and its maintenance is essential for ensuring safe passage for commuters and commercial vehicles. The lawyers' suit seeks a judicial mandate for immediate repairs and improvements to the road, aiming to hold both parties accountable for their negligence.

This legal challenge comes amidst growing public outcry over the state of Nigeria’s road infrastructure and the perceived inaction by authorities. Advocates for road safety are hopeful that this lawsuit will serve as a catalyst for broader reforms in road management and maintenance across the nation.
